General terms of use and sale

Purpose

The purpose of these General Terms of Use is to define the terms under which the Ma-Seedbox.me website, hereinafter referred to as "the Service", is made available, and the conditions under which the User may use the Service.

Definitions

Site: the Site refers to the Ma-Seedbox.me website.

User: the User is any person who uses the Site or any of the services offered on the Site.

Member: the term "Member" refers to a user identified on the Site.

Content: the term "User Content" refers to the data submitted by the User in the various sections of the Site.

Products and services

Ma-Seedbox.me offers Seedbox server rental as well as "WEB Proxy" and "HTTP Proxy" services.

The specifications of the products held by the customer are visible in their member area.

Although Ma-Seedbox.me secures the data on its customers' products as well as possible, through firewalls and regular backups, the customer is advised not to store sensitive data and to make backups on other infrastructure to avoid any risk of loss. Ma-Seedbox.me cannot be held liable for any loss of data.

The customer may request a refund within 14 (fourteen) days of delivery of the product if it does not match the specifications advertised at the time of payment. Any transaction fees related to the payment, as well as the fixed fees for installation and data deletion, will be deducted from the amount to be refunded. The customer undertakes not to abuse this trial offer provided by Ma-Seedbox.me. If the total amount of data transferred by the customer during this trial period exceeds 100 Gigabytes, or if the usage shows that the offer works correctly, Ma-Seedbox.me reserves the right to refuse the refund request, in accordance with Article L121-20-2 of the French Consumer Code (Code de la consommation).

Ma-Seedbox.me reserves the right to stop files from public trackers once the download is complete, in order to ensure the stability of the customer's product.

Payments

The customer may pay for their services via PayPal (which includes payment by bank card).

All payments for products and services are due on the date indicated on the invoice. Upon renewal, the data on the customer's product is retained for 3 days after the payment due date has passed; after this period, the data is permanently deleted. The customer may recover their data by paying their invoice within this period.

The customer may choose to pay in advance upon renewal, without being entitled to request a discount.

Accessibility and delivery

The Ma-Seedbox.me website and all the services offered (free and paid) are accessible 24 hours a day, 7 days a week. However, they may become unavailable for maintenance purposes, whether scheduled or not, or in the event of force majeure.

Ma-Seedbox.me undertakes to do its utmost to restore any services affected by unavailability.

Ma-Seedbox.me cannot be held liable for any damage whatsoever resulting from a service interruption.

The services and products offered by Ma-Seedbox.me are delivered digitally. The customer has access to the information needed to use their products in their customer area. Delivery normally takes less than 5 minutes; however, Ma-Seedbox.me reserves the right to deliver the product up to 7 (seven) days after payment.

Abuse and unlawful content

Pursuant to French Law No. 2004-575 of 21 June 2004 on confidence in the digital economy (loi pour la confiance dans l’économie numérique), to report unlawful content or if you are the victim of fraudulent use by a Ma-Seedbox.me customer, contact us at abus@ma-seedbox.com.

The customer is solely and exclusively liable for any act that infringes French law. Ma-Seedbox.me therefore cannot be held liable for the use of its services by its customers.

Hyperlinks

Ma-Seedbox.me provides hyperlinks to websites published and/or managed by third parties.

Since no control is exercised over these external resources, the User acknowledges that Ma-Seedbox.me assumes no responsibility for the availability of these resources and cannot be held liable for their content.

Force majeure

Ma-Seedbox.me cannot be held liable in the event of force majeure or events beyond its control.

The advertised product specifications, in particular bandwidth, are not guaranteed in the event of a technical problem.

In the event of force majeure, Ma-Seedbox.me may choose to cease its business immediately, providing its customers with a partial refund.

Acceptance and changes to this agreement

This agreement is entered into for an indefinite term from the moment the User uses the Service.

Ma-Seedbox.me reserves the right to modify this agreement at any time. The User will be informed immediately and may choose to terminate their subscription if they disagree with the changes made.

Governing law and jurisdiction

These General Terms and the User's relationship with the Ma-Seedbox.me website are governed by French law. The User and Ma-Seedbox.me agree to submit to the exclusive jurisdiction of the French courts in the event of any dispute arising from these general terms.
